79DaysUK - Terms and conditions

By participating in any 79Days event or challenge, including 'Around the world in 79 days' and/or by registering on 79days.co.uk, app.79days.co.uk and/or of event Facebook group (known as our 'services'), you agree to the following:

Your obligations

  1. You accept that you must be 18 years or over to register an account and/or register your participation. If you are under 18 years, your parents or legal guardians are required to register your account and by doing so give consent and assume responsibility for your 'participation' and use of our 'services'.
  2. Your account will only be used by you and all registered information is true and correct.
  3. You will only 'participate' within your personal physical limits. You accept that we cannot provide advice relating to your personal physical limits or current medical state and you acknowledge you are responsible for your actions and assume all risk (including injury or death) to your person or property resulting from your 'participation' or use of our 'services'.
  4. If required, you will seek medical advice whilst 'participating' and/or using our 'services'.
  5. You will comply with all applicable local, regional and national laws whilst 'participating' and/or using our 'services'.
  6. You will immediately alert us (contact us) regarding any unauthorized use of your account.
  7. You agree to allow us to use anonymous aggregate data to enable 'us' to offer a better service in the future.
  8. You agree to allow 'us' to collect and use data in order to serve advertisements and offers.
  9. You agree to not share your account login information with other people and/or log in to an account not set up by you. If you do, your account may be deleted or suspended without notice.
  10. You acknowledge and agree to all terms and conditions contained on this page.
Fundraising obligations
  1. Ensure that your personal and team 79Days activity is covered by full and comprehensive insurance and understand that Unicef UK is not liable for any injury to person or material damage or loss which results from your participation with this 79DaysUK challenge..
  2. Recognise that you are representing Unicef UK in your fundraising activity and as such you will undertake the planning and delivery in an appropriate manner.
  3. Check all potentially large and/or visible sponsors of this 79DayUK challenge with Unicef UK to ensure that Unicef UK is prepared to accept their endorsement.
  4. Be aware that approval is required from Unicef UK for publicity and promotional material including written, audio and video.
  5. Do not use your connection with Unicef for any kind of commercial gain.
  6. Recognise that this 79DayUK challenge is apolitical and do not involve Unicef UK’s name with any political activity.
  7. Inform your sponsors that no sponsorship will be spent on activity costs and that all monies raised for Unicef UK will be passed on within 3 months via Just Giving.
  8. Inform your sponsors that if costs relating to this 79DaysUK aren’t met by sponsors directly, that these will be paid separately and personal sponsorship will not be used to fund the activity.
  9. Be aware that Unicef UK is not involved with, nor determines the purpose or means of any collection or processing of Personal Data, nor is accountable for ensuring that any and all Personal Data which is collected and/or processed during the fundraising, and the manner of its collection, processing and storage complies with the Data Protection Laws.

Prohibited activities

  1. You agree to never 'participate' or use our 'services' in a way that is or may be harmful to yourself or others. This includes but is not limited to: (a) Training within your personal limits and seeking medical advice when 'participating' and/or using our services, including prior to commencement, at regular intervals, and at any time your level of health or fitness changes; (b) Taking all relevant health and safety precautions whilst 'participating' and/or using our 'services', including but not limited to having regular medical checks, wearing appropriate clothing and footwear, choosing appropriate routes and training conditions; (c) Not using your account to make inappropriate comments or communications (including derogatory, obscene or disparaging remarks) that may be viewed by other people.

  2. You agree you will not 'participate' and/or use our 'services' if you have been medically advised not to do so or you have not received medical clearance to 'participate' and/or use our 'services'. You acknowledge that 'we' will not be liable for any injury, harm or death sustained as a result of using the services.

  3. You agree not to 'participate' and/or use our 'services' in any way that may violate any laws, statutes, ordinances or regulations you may be subject to.
Account rules
  1. 'We' reserve the right to delete or suspend any user accounts at our complete discretion.
  2. Users are fully responsible for any content posted on their accounts. You agree that by 'participating, using our 'services' and/or registering an account that you will not: (a) Provide information that is not complete and accurate.
    Use your account for any illegal purposes; (b) Use sexually explicit content, obscenities, copyrighted material, or abusive/hateful language in any area of the site; (c) Share an account with any other person for the purpose of logging activities.
  3. We may remove any content or block any user from their account for any reason at our sole discretion.
  4. We do not and cannot review all the material posted by users. We cannot be liable for any content or harm that it may cause.
  5. By 'participating' and/or using our 'services' and holding an account you acknowledge you are responsible for protecting yourself from content that is offensive or harmful that may have been posted or sent to you by another user. If you have concerns about any content, please contact us.
  6. When 'participating' and/or using our 'services' you are responsible for online security and protecting your equipment (computer, devices, etc.) from any harm resulting from such use.
Team and personal pages
  1. Your team and personal pages will be publicly available on the Internet, for all to see, including search engines. There are no private or hidden 79Days pages. Your activity is public and irrevocable.
  2. You accept that your 'participation' and/or user of our 'services' allow communication between participants. We are not responsible for any content relating to those communications.
    You are independently responsible for complying with all applicable laws in all of your actions related to your use of our services, regardless of the purpose of the use. In addition, you must adhere to the terms of this Acceptable Use Policy
Liability
  1. We cannot be held liable for any loss, indirect loss, damage, death or injury resulting from your 'participation' and/or use of our 'services'.
  2. We are not liable for the sourcing or supply of any products or services that have not been directly offered to you by us.
  3. We are not liable for any unfair practices, false statements or misrepresentations made by a third party (for example, a Team Captain) in relation to your 'participation' and/or our 'services'.
  4. We are not liable for any comments, posts, messages or other communications made by a user or third party via your 'participation' and/or via our 'services' or service platform(s). We will endeavour to delete and/or restrict any inappropriate content as soon as it is notified to us (contact us).
  5. Our maximum liability for any claim associated with your 'participation' and/or use of our 'services', whether under contract, at law, in equity or otherwise for any loss or damage, is an amount equal to your personal donation to take part.

Warranties

  1. 'We' make no representations or warranties as to the value of 'participation', our 'services' or their fitness for any particular purpose. You agree that you are releasing us from any liability that 'we' may otherwise have to you in relation to or arising from this agreement or our 'services', for reasons including, but not limited to, failure of our 'services', negligence, or any other tort. To the extent that applicable law restricts this release of liability, you agree that 'we' are only liable to you for an amount equal to your total personal donation.
  2. You agree that we are not responsible in any way for claims or offers made by third parties in relation to our 'services' or through our website. This includes any failure of a third party to provide goods or services or the failure of any goods or services to meet your expectations.
    'We' are not responsible for any failures on the part of our third party payment processors.
  3. We are not liable for any failure of the goods or services of our company or a third party, including any failures or disruptions, untimely delivery, scheduled or unscheduled, intentional or unintentional on our website which prevent access to our website temporarily or permanently.
  4. The provision of our 'services' to you is contingent on your agreement with this and all other sections of this agreement nothing in the provisions of this section shall be construed to limit the generality of any other section of these terms.
Indemnification

You agree to defend, indemnify and hold harmless us, our employees, and agents from and against any and all claims and expenses, including legal/attorney fees, costs, and disbursements, arising out of your 'participation' and/or your use of our 'services', including but not limited to, out of your violation of any representation or warranty contained in these Terms and Conditions. In the event of a claim such as one described in this paragraph, we may elect to settle with the party/parties making the claim, and you shall be liable for the damages.

Governing law

These terms and conditions shall be governed by and construed in accordance with English law. Any disputes relating to these terms and conditions shall be subject to the non-exclusive jurisdiction of the courts of England.

Severability

If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision of these terms and conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Amendments

We may revise these terms and conditions from time to time. The revised terms and conditions shall apply to the use of our website from the date of publication of the revised terms and conditions on the website, and you hereby waive any right you may otherwise have to be notified of, or to consent to, revisions of these terms and conditions. If you have given your express agreement to these terms and conditions, we will ask for your express agreement to any revision of these terms and conditions; and if you do not give your express agreement to the revised terms and conditions within such period as we may specify, we will disable or delete your account on the website, and you must stop using the website.

Our website includes hyperlinks to other websites owned and operated by third parties; such hyperlinks are not recommendations. We have no control over third party websites and their contents, and we accept no responsibility for them or for any loss or damage that may arise from your use of them.

Assignment

You hereby agree that we may assign, transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms and conditions – providing, if you are a 'participant', that such action does not serve to reduce the guarantees benefiting you under these terms and conditions. You may not without our prior written consent assign, transfer, sub-contract or otherwise deal with any of your rights and/or obligations under these terms and conditions.
